Terms of Use
Effective 20 October 2026 · HopNPark Pty Ltd
Plain-English terms for drivers and anyone using the HopNPark website and apps.
1.About these terms
These terms apply when you use the HopNPark website, driver app, business app or any HopNPark service (together, "HopNPark"). HopNPark is provided by HopNPark Pty Ltd, Sydney, Australia. By creating an account or using HopNPark you agree to these terms and our Privacy Policy.
Car park operators, councils and businesses that use HopNPark to run their parking have separate agreements with us. Those agreements, not these terms, cover their use of the operator and business portals.
2.Your account
- You must be 16 or older, or have a parent or guardian's permission, and give us accurate details.
- Keep your password and devices secure. You are responsible for parking and payments made through your account, including by anyone you let use it.
- Tell us straight away at [email protected] if you think someone else is using your account.
- Make sure the number plates on your account are correct and belong to vehicles you are allowed to use. Wrong plates can mean the gate won't open or someone else's parking is charged to you.
3.Parking through HopNPark
HopNPark is the technology that lets you find, book, pay for and manage parking. The car park operator or council runs the car park or street parking and sets its prices, opening hours, rules, signs, time limits and conditions of entry.
- When you park, you also agree to the operator's or council's conditions shown at the site or in the app. If they differ from these terms, the site's conditions apply to the parking itself.
- Prices, availability and estimates shown in the app come from the operator and can change until you book or start parking.
- A booking gives you the right to park for the booked time, not a particular bay unless the booking says so.
- Gates, cameras and other site equipment belong to the operator. If something doesn't work, use the in-app help or intercom, or contact the car park.
- Parking fines, infringement notices and towing are issued by the operator, council or authorities, not by HopNPark. Starting a session in the app doesn't stop you being fined if you break the rules on the signs.
4.Payments
- You authorise us and our payment providers to charge your saved payment method for parking, bookings, permits, passes, extensions, overstays and any fees shown before you confirm.
- Pay-by-plate parking is charged when you leave, based on the time the cameras record and the site's rates.
- Some operators take payment through their own payment provider; your receipt shows who charged you.
- Prices include GST where it applies. Receipts are in the app and emailed to you.
- If a payment fails, we may stop new parking on your account until it's paid.
5.Cancellations, refunds and disputes
- Each booking shows its cancellation terms before you pay. If you cancel within those terms, we refund you to your original payment method.
- If you think you were charged wrongly (for example a camera misread or a gate fault), dispute it in the app within 30 days. We'll review it with the operator and refund any amount that was charged in error.
- Nothing in these terms limits your rights under the Australian Consumer Law (see section 10).
6.Permits, passes and business parking
Permits, monthly passes, staff parking and visitor parking follow the rules set by the operator, council or business that issues them, such as who qualifies, renewals, waitlists and how bays are shared. They are personal and linked to the plates on them, and may be cancelled if the rules aren't met.
7.Parker, our AI assistant
Parker can answer questions and book, extend or end parking for you. It works from the information it has and can make mistakes. Parker always asks you to confirm before paying for anything; please check the details before you confirm. Parker's answers are not legal or professional advice, and the signs and conditions at the site take priority over anything Parker says.
Don't use HopNPark or talk to Parker in a way that distracts you while driving. Use voice or drive mode only when it's safe and legal, and follow the road rules.
8.Using HopNPark properly
Please don't:
- Use false plates, someone else's account or payment method without permission
- Try to avoid paying, get around a gate or camera, or misuse permits and offers
- Interfere with, copy, reverse-engineer or overload HopNPark, or access it with bots or scrapers
- Upload anything unlawful, or harass car park staff or our support team
We may suspend or close an account that breaks these terms, after warning you where reasonable.
9.Availability and changes
We work to keep HopNPark running 24/7, but it may sometimes be unavailable for maintenance or reasons outside our control, such as network, phone or site equipment faults. If the app isn't working, use the site's other options, such as the pay station, intercom or attendant, or contact the car park. We may improve or change features over time.
10.Your consumer rights
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes those rights.
11.Our liability
To the extent the law allows, and apart from your rights under the Australian Consumer Law:
- HopNPark isn't responsible for the car park or street itself, including damage to or theft from vehicles, injuries at the site, or the operator's or council's decisions, fines or towing;
- we aren't liable for indirect losses, such as lost time or missed appointments; and
- where our liability for a service can be limited, it is limited to supplying the service again or refunding what you paid for it.
Nothing in these terms limits liability that can't be limited by law, including for our own negligence causing personal injury.
12.Ending your account
You can close your account at any time in the app (Account › Privacy › Delete my account) once upcoming bookings are cancelled and anything owed is paid. We keep receipts as our Privacy Policy explains.
13.Changes to these terms
We may update these terms. We'll show the new effective date here and, for important changes, tell you in the app or by email before they apply. If you keep using HopNPark after that, the new terms apply.
14.Law and contact
These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales can hear any dispute.
